Terms of Service

These terms are the agreement between you and Durima LLC ("we", "us"), a Wyoming limited liability company. We operate Fitted: the text-message styling service, its website and cart pages, and the images made for you.

Please read all of it. These points matter most:

1. Agreeing to these terms and who can use Fitted

1.1 How you agree. You agree to these terms when you sign up on our website and tap Send code beneath the notice that links to them. That happens before Fitted styles you. We keep a record of the version you agreed to and when.

If you text us before signing up, we reply with the sign-up link and nothing else. If you don't agree to these terms, don't use Fitted.

1.2 Who can use Fitted. To use Fitted you must:

1.3 Fitted is for adults. We ask for your birthday to check that you are 18 or older. We may ask for more to confirm your age if the law requires it or if we have reason to doubt it. AI chatbots like Fitted may not be suitable for some minors, and Fitted is not open to anyone under 18.

If we learn that a member is under 18, we close the account. We delete their photos and the data taken from them, unless the law requires us to keep something (see section 6.5).

1.4 Fitted is an AI. Fitted is artificial intelligence. Its messages are written by AI software or sent automatically, not by a person, unless a message says someone on our team wrote it.

Fitted says it is an AI at the start of a conversation. If you ask whether you are talking to a person, Fitted is built to say that it is an AI.

Fitted's tone is friendly. That is a style. It is not a person, a human stylist or a licensed professional, and it can be wrong.

1.5 Invitations. Fitted is invite-only for now. An invitation or a place on the waitlist does not guarantee access, and we may limit or pause sign-ups.

Invitations are personal. You send them yourself, and you may not sell them. We never text someone only because you gave us their number.

1.6 Your account. Keep your phone and your account secure. You are responsible for texts sent to us from your number.

Tell us before you change or give up your mobile number, so that we don't text the next person who gets it. You can update your details at textfitted.com/account or by texting us.

1.7 Fitted is free. We don't charge you to use Fitted, and we never take payment from you. Section 5 explains how we earn money.

1.8 The service will change. Fitted is new. We may add, change or remove features, and we may stop offering Fitted. We don't promise that Fitted will always be available or that it will work with every phone, carrier or messaging app.

2. Text messaging terms

2.1 The program. Fitted is a text-message program run by Durima LLC. Texts come from [Fitted's number]. Depending on your phone, they arrive as iMessage, RCS, SMS or MMS, sent through our texting provider.

2.2 Replies. When you text Fitted, you are asking us to text you back, and you agree to receive our replies. Replies include looks, images, questions, a link to your cart page, and answers to anything you ask.

We reply whenever you text us, at any hour, unless you have texted STOP. We also text you a one-time code when you sign in, because you asked for it.

2.3 Texts we start. Fitted mostly texts when you text it. We also follow up from time to time when we think it is useful. For example, we may ask how a look worked out, tell you something is back in stock, or suggest an outfit.

You can turn these follow-ups off at textfitted.com/account, or by texting QUIET.

2.4 Your consent. By giving us your mobile number and agreeing to these terms, you agree that Durima LLC, doing business as Fitted, may send recurring texts to that number, including marketing texts. They are written by AI and may be sent using automated technology. Message frequency varies.

Your consent to marketing texts is not a condition of using Fitted or of buying anything. You can turn them off at any time at textfitted.com/account or by texting QUIET.

2.5 Cost. Message and data rates may apply. We don't charge for texts, but your carrier might, including for picture messages.

2.6 How to stop. Reply STOP to stop all texts from Fitted. QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE work too, and so does telling us in your own words. You can also email support@textfitting.com or write to the address in section 11.6.

We stop as soon as our system receives your request, and in every case within 10 business days. We send one text to confirm, and then nothing more. After STOP, we text you again only if you text START.

That includes sign-in codes. After STOP, we email you a link to sign in to your account page instead. You can still text "delete my photo" or email us a privacy request. We act on it and confirm by email. To close your account, use textfitted.com/account.

STOP ends our texts. It does not delete your account or your data. To do that, see section 11.3.

2.7 Other commands.

2.8 Account notices. We may text or email you about your account or these terms, for example a security notice or a change to these terms. These are not marketing. If you have texted STOP, we send them by email.

2.9 Delivery. Carriers and messaging platforms are not liable for delayed or undelivered messages. We can't promise that every text arrives, or which channel a text uses. Text messages are not a secure channel, so don't send us passwords or payment card numbers.

2.10 Your number and group chats. We text the mobile number you signed up with. If you add Fitted to a group chat, Fitted replies there, and everyone in the chat can see what it says. Add Fitted only to chats where everyone is 18 or older and is happy to have it there.

We do not sell, rent or share your mobile number or your consent to receive texts with anyone for their marketing. We keep a record of your consent and of any request to stop, so that we can honor them.

3. Photos and the people in them

3.1 Photos are optional. You can use Fitted without sending a photo. We then style you from your answers and sizes, without try-on images.

3.2 Your consent to our use of photos. By agreeing to these terms and sending us a photo, you allow us to collect, store and use the photo and what our software reads from it. That includes face data, which some state laws treat as biometric data. Agreeing to these terms is your written consent and release for this.

We use it to make and check try-on and scene images, to choose colors, cuts and sizes, and to develop and improve Fitted as section 8.3 describes. We keep it until you delete it or close your account, and never longer than our public schedule at textfitted.com/biometrics allows. We do not sell it.

3.3 Photos of you. When you send a photo of yourself, you confirm that you are the person in it and that you have the right to send it. If someone else took the photo, you confirm you are allowed to use it this way.

3.4 Dressing someone else. You can ask Fitted to dress another adult, such as a partner or a friend, or two people together. Two rules apply.

  1. You confirm that every person in every photo you send is 18 or older.
  2. You confirm that they know you are sending the photo to Fitted, and that they agreed to it. Their agreement must cover being photographed, having AI images made of them, and our use of their photo and face data as section 3.2 describes. Getting that agreement is your responsibility.

Each person you dress is saved separately on your account. They can ask us directly to see or delete their photos and data at support@textfitting.com. We can't confirm who is in a photo, so we rely on what you tell us.

3.5 Photos you must not send. Do not send a photo that shows:

Photos of clothes you own are welcome. Crop out anyone who hasn't agreed to be in them.

3.6 What you allow us to do with photos. You keep all rights in your photos. You give us permission to store, copy and adjust your photos, and to make new images from them, to provide and improve Fitted. We don't pay for this permission, and it doesn't stop you from using your photos anywhere else. The permission covers:

It also covers our service providers, who process photos for us under contracts that limit them to this work.

We do not sell your photos, use them in advertising, or show them to other members.

3.7 Deleting photos. Text "delete my photo" at any time, or use textfitted.com/account. We then delete your photos, every try-on and scene image made from them, and everything we read from them. To delete only one person's photos, tell us who.

They leave our live systems right away and our backups within 30 days. The permission in section 3.6 ends when they are deleted. The only exception is material the law requires us to keep (see section 6.5).

We can't delete images you have already saved or sent to other people. Cart-page links that showed those images stop working. Deleting photos does not change AI models already trained with them.

3.8 If someone used your photo without asking. If you believe a photo of you was sent to Fitted without your agreement, email support@textfitting.com. You don't need an account. We remove the photo and every image made from it within 48 hours of a valid request, and we may close the account that sent it.

4. AI-generated images

4.1 What they are. A try-on image shows clothes on a photo of you or of the person you are dressing. A scene image shows the look you picked in a new setting and pose. Both are made by AI.

They are illustrations, not photographs. Nobody was photographed wearing those clothes, and the scenes never happened. The setting in a scene image is invented, and scene images are built to show only the people you asked us to dress.

4.2 How accurate they are. They are not exact. The real fit, drape, length, color, pattern, texture and proportions of a garment can differ from the image. AI can also change details of a person or a garment, or get them wrong.

We check each image against the original photo so that the face, skin tone, body shape and apparent age stay true. That reduces errors. It does not remove them.

We do not guarantee that any image is accurate. Don't rely on an image to choose a size. Check the retailer's size chart and return policy before you buy.

4.3 Who owns them. You keep all rights in your photos. Between you and us, the try-on and scene images we make for you are yours. If we hold any rights in them, we transfer those rights to you.

We keep the permission we need to store and show those images to provide Fitted, until they are deleted.

Under US law, images made by AI may not be protected by copyright. So we can't promise that anyone owns copyright in them, or that they are unique. Fitted may make similar images for other members.

The clothes, logos and designs shown in an image belong to the brands. Nothing in these terms gives you rights in them.

4.4 Using and sharing them. You may keep the images, send them to friends and post them on your own social accounts. These rules apply:

4.5 Cart pages and their links. Each look has a cart page at a private link. The link is hard to guess, and we tell search engines not to index it. Anyone who has the link can open the page and see the images on it, so share it only with people you want to see it.

We may take a cart page down at any time. A cart-page link can last up to a year. It stops working sooner if you delete the look, delete the photos behind it, or close your account.

4.6 Images Fitted does not make. Fitted is built not to make:

Fitted can still recommend underwear, lingerie and swimwear in words, without a try-on image.

5. Recommendations, prices and stock

5.1 Fitted recommends. Retailers sell. Fitted suggests clothes and links you to the retailers that sell them. Fitted is not the seller. We never take your payment, place an order for you, or handle shipping, returns or refunds.

5.2 Buying. Fitted texts you a link to a cart page on our website. From there you check out on each retailer's own site. Your purchase is a contract between you and that retailer.

The retailer's terms and policies govern price, payment, shipping, returns, refunds, exchanges and warranties. If something goes wrong with an order, contact the retailer. If you ask, we'll help you find the right contact.

5.3 Prices and stock. Prices, sizes, colors and stock come from retailers and can change at any time. Each cart page shows when we last checked. If the retailer's page differs from what we showed, the retailer's price and availability apply.

The price we show is the retailer's listed price for the item. The retailer adds tax, shipping and any fees at checkout. We don't promise that an item will be in stock, in your size, or at the price we showed.

5.4 How Fitted is paid. Fitted earns a commission from retailers and affiliate networks when you buy through our links. That is how we make money. It does not change the price you pay.

We say this on every cart page.

5.5 How we choose. We choose pieces to suit your request, taste, sizes and budget. The system that picks and ranks pieces is not given commission rates.

We mostly show retailers that pay us a commission, so commissions do shape which retailers you see. If a brand ever pays to be featured, we will label that as sponsored.

5.6 Tracking codes. So that we can be paid, our retailer links carry a tracking code. It tells the retailer or network that the click came from Fitted, and it lets us match a purchase to your look. The code does not contain your name, phone number or email.

Networks report back to us when a purchase is made through a link. Our Privacy Policy at textfitted.com/privacy explains this.

5.7 Advice, not guarantees. Style, size and fit suggestions are opinions. Sizes vary from brand to brand. We don't guarantee that anything will fit, suit you, or arrive in time for your occasion.

Product descriptions and photos come from retailers. We are not responsible for their mistakes.

5.8 Brands. Brand and product names belong to their owners. Naming a brand does not mean it sponsors or endorses Fitted.

6. Acceptable use

6.1 The rules. Do not use Fitted to:

6.2 What we may do. Fitted may refuse any request. If we reasonably believe you have broken these terms or the law, or that someone's safety is at risk, we may remove content, pause your account or end it.

We tell you why, unless the law or someone's safety prevents that. In serious cases we may act without warning.

6.3 Checking content. We may use automated tools to check messages and photos against these rules. Someone on our team may look at content when a tool flags it, when you report a problem, or when the law requires it.

6.4 Explicit images. If we find that you sent a nude or sexually explicit image of an adult, we do not use it and we delete it. If it happens again, we may end your account.

6.5 Images involving minors, and reports the law requires. We do not knowingly use photos of anyone under 18. If you send an ordinary photo that appears to show a minor, we do not use it and we delete it.

Apparent child sexual abuse material is different. If we become aware of it, we do what federal law requires. We:

A request to delete your photos or your account does not override this. We also report other apparent crimes against children that the law requires us to report, such as trafficking or enticement.

6.6 Legal requests and safety. We may share information with law enforcement when the law requires it, or when we believe it is needed to protect someone from serious harm. Our Privacy Policy explains this.

6.7 Reviews. Nothing in these terms limits your right to post honest reviews of Fitted.

6.8 Reporting a problem. To report abuse, a safety concern, or content that breaks these rules, email support@textfitting.com.

7. Safety

7.1 What Fitted is not. Fitted gives style suggestions. It is not a medical, mental health, legal or financial service. It is not a doctor, therapist, counselor, lawyer or financial adviser, and you should not rely on it as one.

7.2 If you are in crisis. Fitted cannot call for help, and people do not watch conversations as they happen. If you or someone else is in danger, call 911.

If you are thinking about suicide or self-harm, or you are in emotional distress:

For support with an eating disorder, call the National Alliance for Eating Disorders helpline at 866-662-1235, Monday to Friday, 9 a.m. to 7 p.m. Eastern. It is run by licensed therapists. It is not a crisis line, so in a crisis use 988.

7.3 What Fitted does. Fitted is built to notice when a message suggests you may be thinking about suicide or self-harm. When it does, it stops styling and points you to the crisis services above. It can miss things, so don't rely on it in a crisis.

Fitted is also built not to produce content that encourages or describes suicide or self-harm.

Our safety protocol is published at textfitted.com/safety.

7.4 Bodies, weight and eating. Fitted styles the body you have. It is built not to give advice about weight, dieting or changing your body. If you tell it you are struggling with eating or with how you see your body, it is built to point you to support.

7.5 Health details. You never need to tell Fitted about your health. If you mention something so that we can style around it, such as a pregnancy or a skin condition, Fitted asks for your OK before using it. With your OK, we use it only to style that request, and we don't save it to your profile. Our Privacy Policy explains how.

Fitted's suggestions are not medical advice. If you have an allergy or a skin condition, check fabric and care labels yourself.

8. Intellectual property

8.1 What is ours. Fitted's name, logo, website, text, design and software belong to Durima LLC or its licensors. They are protected by copyright, trademark and other laws.

8.2 What you may do. While these terms are in effect, you may use Fitted for your own personal, non-commercial purposes. This permission is limited, non-exclusive and non-transferable, and we can withdraw it under section 6.2.

You may not copy, change, distribute or sell any part of Fitted, except where these terms allow it. Section 4.4 covers the images we make for you.

8.3 Your messages. You keep your rights in the messages you send us. You allow us to use them to run, protect and improve Fitted, as our Privacy Policy describes. Section 3.6 covers photos.

We may use your messages, your photos and the other information you send us to develop and improve Fitted, including to train the AI models that power it. You can opt out of AI training at any time in your settings at textfitted.com/account. The opt-out applies from then on, and only to training. We may keep using models trained before you opted out. Our Privacy Policy explains this.

8.4 Feedback. If you send us ideas or suggestions about Fitted, we may use them freely, without payment or any obligation to you. You don't have to send any.

8.5 Copyright complaints. If you believe something on Fitted infringes your copyright, send a notice to our copyright agent. Email support@textfitting.com, call (512) 593-1492, or write to Copyright Agent, Durima LLC, 30 N Gould St Ste N, Sheridan, Wyoming 82801.

Your notice must include:

We act on valid notices and remove material that infringes. In appropriate cases, we end the accounts of people who infringe repeatedly.

9. Disclaimers, limits on our liability, and when you cover our costs

9.1 Fitted is provided as it is. Fitted is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied. That includes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not promise that:

9.3 Limits on our liability. To the fullest extent the law allows:

Fitted is free. These limits are part of the basis on which we can offer it.

9.4 What the limits do not cover. The limits in section 9.3 do not apply to:

9.5 New Jersey residents. If you live in New Jersey, sections 9.1, 9.3 and 9.6 apply to you, with three exceptions. Nothing in these terms limits:

Section 10, including arbitration and the class action waiver, applies in New Jersey.

9.6 When you cover our costs. This applies only if someone else brings a claim against us because:

In that case, you agree to pay the reasonable costs and damages we incur because of the claim, including reasonable legal fees. We will tell you about the claim promptly. You do not have to cover any part of a loss that our own conduct caused.

9.7 Who these sections cover. In sections 9 and 10, "we" also means Durima LLC's owners, staff and service providers, for claims about Fitted.

10. Disputes

Please read this section carefully. It changes how disputes between you and us are resolved. You and we agree to resolve most disputes in arbitration instead of in court. You and we each give up the right to a jury trial and the right to take part in a class action.

10.1 Talk to us first. Most problems can be fixed quickly at support@textfitting.com. If that doesn't work, the side with the complaint sends the other a written notice of dispute.

Send a notice to us at support@textfitting.com, or by mail to the address in section 11.6. We send a notice to you at the email on your account. The notice must give the sender's name, the mobile number on the account, what the dispute is about and what the sender wants. The person bringing the dispute must sign it personally.

You and we then try in good faith to settle for 30 days. Neither side may start an arbitration or a court case until those 30 days end. Any deadline for bringing the claim is paused during that time.

10.2 Agreement to arbitrate. If the dispute is not settled in 30 days, you and we agree to resolve it by binding arbitration, not in court. This covers any dispute or claim that arises from or relates to Fitted, including:

It applies whatever the legal basis of the claim, including contract, negligence, fraud and claims under a statute. It does not cover disputes that have nothing to do with Fitted.

In arbitration, a neutral arbitrator decides the dispute instead of a judge or jury. The arbitrator can award you the same damages and relief that a court could award you individually. Court review of an arbitration award is limited.

10.3 What is not arbitrated.

10.4 No class actions. You and we may each bring claims against the other only as individuals. Neither may act as a plaintiff or class member in a class, collective or representative proceeding. The arbitrator may not hear class or representative claims, and may award relief only to the individual party and only as needed to resolve that party's claim.

The AAA may group or coordinate similar cases under its rules. If a court decides that this section cannot be enforced for a particular claim or request for relief, that claim or request, and only that one, goes to court. Everything else stays in arbitration.

10.5 The rules. The American Arbitration Association (AAA) runs the arbitration under its Consumer Arbitration Rules in effect when the arbitration is filed, as changed by this section. The rules are at adr.org, and we will send you a copy if you ask. If the AAA cannot run the arbitration, a court will appoint another administrator.

The Federal Arbitration Act governs this section. The arbitrator decides the dispute. The arbitrator also decides whether a claim must be arbitrated and whether this section is valid, with one exception: only a court may decide whether section 10.4 can be enforced.

10.6 How it works.

10.7 Your right to opt out. You can opt out of arbitration within 30 days after you first agree to these terms. Email support@textfitting.com with the subject "Arbitration opt-out", or write to the address in section 11.6. Give your name and the mobile number on your account, and say that you opt out.

If you opt out, sections 10.2 to 10.8 do not apply to you, and disputes go to court under section 10.9. Opting out does not affect anything else in these terms or how we treat you.

10.8 Many similar claims. If 25 or more similar claims are filed against us by the same or coordinated lawyers, the AAA's Mass Arbitration Supplementary Rules apply. Its fee schedule for those cases then sets what each side pays. No one is bound by a decision in a case they are not part of.

Any deadline for bringing one of those claims is paused from the day we receive the notice in section 10.1 until that claim's arbitration starts or the claim is withdrawn.

10.9 Governing law and courts. Wyoming law governs these terms and any dispute about Fitted. If you live in California, California law governs instead. Wherever you live, you keep the protection of your home state's consumer laws that cannot be waived by agreement.

A dispute that is not arbitrated, and is not in small claims court, must be brought in the state or federal courts for the county where you live.

10.10 Changes to this section. Section 11.1 applies to changes to this section.

A change never applies to a claim that arose before the change.

10.11 If part of this section fails. If a court finds any part of this section other than section 10.4 unenforceable, that part is removed and the rest stays in force. Section 10.4 says what happens if it cannot be enforced. This section continues to apply after your account ends.

11. Changes, ending your account, contact, and how our documents fit together

11.1 Changes to these terms. We may change these terms at any time. When we do, we update the date at the top. If a change is material, we make reasonable efforts to tell you, for example by email or text.

A change takes effect when we post it, or on a later date that we give. If you keep using Fitted after that, you accept the change. If you don't agree, stop using Fitted and close your account. A change does not apply to a dispute that is already in arbitration.

11.2 If we pause or end your account. We may pause or end your account under section 6.2. We may also stop offering Fitted. If we do, we will try to give you at least 30 days' notice so that you can save your looks.

11.3 Closing your account. You can stop using Fitted at any time. You can close your account yourself at textfitted.com/account. We confirm it is you with a code sent to your phone, or by email if you have texted STOP.

We then close the account and delete your information as our Privacy Policy describes.

11.4 What continues. These sections continue to apply after your account ends: 3.3, 3.4, 4.3, 4.4, 5, 6.5, 8, 9, 10 and 11. Sections 3.6 and 3.7 continue for any material the law requires us to keep.

11.5 How our documents fit together. Your agreement with us is made up of these terms. Our Privacy Policy at textfitted.com/privacy explains how we handle personal information.

If two documents disagree:

A retailer's own terms govern anything you buy from it.
